Listing of Allowed Goods for Rental

The Company provides an online platform to connect Owners and Renters. Any User who wants to use the Services of SRK needs to be eligible to enter into a legally binding agreement with the Company. You, as an Owner can post the image of the Allowed Goods which you intend to give on rent to a prospective Renter, its description, rental fee, security deposit for giving the item on rent, updated calendar on the availability of the items and other related documents, if any on SRK (“Listing”). You represent that you are the sole owner of such goods that are being given on rent. Further, it is agreed that you are responsible for any content posted by you on SRK. All the Allowed Goods for Rental shall be put up in the appropriate category of goods and within the applicable city. Placement of a Listing in a particular category by an owner can in no instance be interpreted as a guarantee on the Company’s part regarding the origin and authenticity of the listed goods. The Company may, in its sole discretion and at any time update, change, suspend, make improvements to or discontinue any aspect of the Services, temporarily or permanently.

Other provisions for a particular rental like delivery, deposit amount, rental fee and any other charges or service in relation to the rental shall be clearly mentioned in the ‘description’ section for a particular Allowed Goods for Rental. A Renter always has the option to pick the rented good from the Owner’s place directly or to select a delivery option on SRK.

The Owner may not mention about his/ her personal information such as address, phone number, email address etc. anywhere on the Listing. Owner is entitled to mention specific condition of the rental, if any on the Listing. Owner hereby represents that he/she either has the complete ownership on the goods/ services that are being listed on SRK or possess the necessary license or rights to put the goods/ services on rent. In no event, the Owner shall modify the rental price upon posting the Listing on SRK. It is agreed that before accepting any rental offer, the Owner or Renter will not share their identities and personal information for any reason whatsoever.

Content of the Listing

The Owner hereby grants to the Company, a perpetual, royalty-free, sub-licensable rights and license to use, host and broadcast the content of the Listing on SRK and/or the Company’s affiliate websites. The Company has the right to moderate, edit or alter the content of the Listing, at its own discretion. The Company does not have any legal obligations with regard to such content posted by the Owner.

The Owner hereby represents that he/ she possess all the intellectual property rights on the content of the Listing including without limitation to the description, image and other visual elements.

Allowed Goods for Rental

Owners agree to offer for rent such goods/ services that are part of regular commerce and further warrants that holding and usage of such goods/ services including its rental are legal and authorized.

Owner hereby represents that the Allowed Goods for Rental offered for rent on SRK contain no defects that would put the Renter in danger. Further, the Owner agrees not to offer for rent such goods that are banned or the usage or rental of which would constitute a violation of law. The Owner shall read, agree and comply with the Listing Policy of SRK and not to offer those items as per theListing Policy and those which are prohibited under the applicable laws.

Third Party Verification
The Company may engage a third party verification agency to verify the quality, working conditions and other major defects in the products listed or rented by any Owner through SRK. Upon verification of the same, the Company mat rate such products which will be visible to prospective Renters.

Booking
The Owner shall maintain an updated calendar as to when the items are available for rent in the Listing and shall abide by the same. Depending on the Renter’s Search, SRK will display the available items for rent from plurality of Owners. The Renter is free to select any Owner depending on his requirement of available dates, rental fee and other criteria. Upon selection of a particular item, the Renter can send a request to the Owner for renting the same by sending them the number of hours, days or months for which the Renter wishes to rent the item. The Owner can accept such request on its sole discretion. Upon acceptance of such request by the Owner, both the Parties shall agree to the Renting Policy of SRK and shall enter in to a Rental Agreement. Once the Rental Agreement has been accepted by the Parties, Renter shall be liable to pay the rental fee, Service Fee, security deposit, if any and other miscellaneous charges upfront to process the rental transaction. The duration of a rental cycle shall commence at 3 p.m. on the start date and ends at 3 p.m. on the last date of the period selected by the Renter.

Pricing Policy

The price of each item listed on SRK is expressed in Indian Rupees. The Price includes any taxes and costs, excluding possible delivery fees and extra insurance costs (if any).

With the exception of promotional offers that are explicitly outlined on SRK, fees are charged to the Owner and Renter once a Rental Agreement is executed between them (“Service Fee”). However, access, registration, Listing and use of SRK is free for its Users. The Company at its sole discretion can modify its policies on Listing and Service Fee which will be effective on all subsequent transactions. The Service Fee shall be paid by the Renter to the Company upon executing the Rental Agreement with the Owner along with the rental fee for the mentioned rental cycle and security deposit. The Company acts as an escrow agent in collecting, retaining and refunding the rental fee and security deposit for the item on rental. Upon successful completion of rental cycle and safe return of the rented item back to the Owner, the security deposit taken from the Renter shall be refunded back to the Renter and rental fee shall be transferred to the Owner deducting the Service Fee to their respective bank account as given and approved by them.

Confirmation of the rental service will depend on the payment of the rental fee and security deposit by the Renter even after execution of the Rental Agreement. The Service Fee is charged by the Company in the name of and to the account of the Renter and Owner, as a percentage on the total rental amount listed in the Listing. A proof of payment of this Service Fee is always available in the User’s Account. Payment by the Renter can be made online via a credit or a debit card or net banking facility of your available bank.

Users are solely liable for all the taxes, fees and commissions resulting from use of SRK and its Services. Taxes including but not limited to, sales tax, goods and services tax and VAT might be applicable to your transaction whether you are an individual or a legal entity, or whether you are an Owner or a Renter. Users are encouraged to seek tax advice from a professional.

Invoicing information, billing payment and invoice history are available online in the respective User account. Once the rental fee, Services Fee, security deposit and other miscellaneous expenses are paid by the Renter, an invoice is generated and made available to your account, which is accessible. In case of the Owner, the invoice is generated upon the successful completion of rental cycle and after deduction of Service Fee from the Rental Fee.

Payments are made by clicking on the button “[•]” at the time of execution of Rental Agreement. We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any transaction, on account of the cardholder having exceeded the preset limit mutually agreed by the Company with the acquiring bank from time to time.

Delivery and Pickup Policy

The User shall be provided with an option to select the delivery type they want for the logistics of the items rented, from the following:

In option (a), the Owner and Renter can choose and manage their own logistics. However they are responsible for the delivery time of the project at Renter’s place before the rental cycle starts. For certain items, Renter/ Owner, as the case may be who are managing their own logistics for the delivery of items, SRK shall send a unique code to the User’s registered phone number for authentication purposes. The User shall abide by the timeline mentioned in the below paragraph in relation to the delivery of the item else shall choose SRK’s logistics in order to have a smooth transaction.

In option (b), SRK shall provide logistics for the delivery and return of the rented item(s) from the Owner and Renter, as the case may be, subject to the payment of such logistics expenses by the Renter upfront along with the other fees upon execution of the Rental Agreement. The transit period will be standard based on our guidelines within the city where the Owner and Renter are residing. The item shall be picked up from the Owner’s place and delivered to the Renter on or before the rental cycle starts i.e. 3 p.m. on the first date of rental cycle and the same shall be picked form the Renter’s place on the last date of the rental cycle within anytime between 3 p.m. to 9 p.m., by SRK’s logistic partners.

Cancellation Policy

Cancellation by Renter: Once a booking transaction is completed along with the payment of necessary fee by the Renter to SRK, Renter is entitled to cancel such booking subject to following conditions. If the Renter cancels any accepted and completed booking:
-
within seven (7) days prior to the start date of such rental cycle, Renter will not be charged any cancellation charges;
-
within four (4) days prior to the start date of such rental cycle, Renter shall be charged 25% of the rental fee already paid;
-
within two (2) days prior to the start date of such rental cycle, Renter shall be charged 50% of the rental fee already paid; and
-
any time after the above mentioned time limit, the rental fee paid by the Renter shall not be refunded unless and until Owner makes the initiation to cancel the booking.

In case the rental cycle is for more than a month, then the cancellation charges (as the% of the rental fee) as mentioned will be charged on one month rental fee only and the remaining amount shall be transferred to the Renter including the security deposit. The cancellation charges collected from the Renter will be transferred to Owner after deduction of SRK’s Service Fee.

Cancellation by Owner:
-
Once a booking transaction is completed along with the payment of necessary fee by the Renter, Owner is entitled to cancel such booking subject to following conditions. If the Owner cancels any accepted and completed booking:
-
within seven (7) days prior to the start date of such rental cycle, Owner will not be charged any cancellation charges;
-
within four (4) days prior to the start date of such rental cycle, Owner shall be charged Rs.250/-;
-
within two (2) days prior to the start date of such rental cycle, Owner shall be charged Rs.500/-; and
-
any time after the above mentioned time limit, Owner shall be charged Rs.1,000/-.

In above cases, Renter shall be refunded with the full amount paid for the rental including miscellaneous expenses. Further, Renter shall also be given coupons worth the cancellation charge as mentioned above depending upon the scenario. The cancellation charges shall be collected from the Owner from his subsequent transactions through SRK. Normally, a rental booking shall not be cancelled by the Owner during the rental cycle. However, in the event of Renter reporting any issue with the item rented by the Owner, the Owner either has the option to fix the item and return or cancel the rental booking incase the item cannot be fixed. In such cases, SRK shall stop the rental cycle upon the intimation of issue by the Renter and notifies the Owner. It is at the discretion of the Owner to fix the item and restart the rental cycle or to cancel the rental booking.

In the event of the Owner taking responsibility in fixing the item, the item will be delivered at the Owner’s place depending on the logistics chosen. Upon fixing the item within the stipulated timeline, SRK has to be intimated with the reason for issue and initiation of the rental cycle by the Owner. The Owner is free to record his/her feedback regarding the issue with SRK. However, rental cycle in such cases shall be started only after SRK confirming with the Renter. In case the item cannot be fixed during the rental cycle, then the Owner has the option to cancel the booking request by contacting SRK. When cancellation is opted, Owner would be paid only for the days on which the item was used and Renter shall be refunded the remaining amount of rental fee and security deposit.

In the event of Owner making a claim that the issue was due to the Renter manhandling the item, the procedure as mentioned above shall be followed. However, the cost of fixing the item by the Owner shall be deducted from the security deposit paid by the Renter. A proof of bill showing the repair cost is mandatory for making such claim by Owner.

The cancellation can be made through the options available online on their respective profile or by contacting the call center executives of the Company.

Renter Obligation
The Renter agrees to following:

Renter is solely responsible for honoring any confirmed bookings and making available any Listings reserved through the Service.

Renter has to acknowledge and agree that for any transaction, Renter will enter into an agreement with Owner and they will solely be responsible for executing such agreement as per the terms and conditions of agreement. Renter further agrees that the Company shall not be a Party to any such agreement and will not be liable for any loss, damage caused due to such Agreement.

Renter also agrees that the Company does not have to refund any money for any services provided by the Company.

Owner Obligation
The Owner agrees to following:

Owner agrees that he/ she will review the Rental Agreement and offer it in entirety before accepting the same.

Owner further agrees that the Company will in no way held liable for any loss caused due to any transaction of Owner and Renter including any loss or damages to Owner.

Owner has to make the items available for rent on the mentioned calendar dates without fail.

Damage or Loss
In case the goods rented are damaged due to some act or omission of the Owner, the Renter will be liable for any and all compensation as agreed on the Rental Agreement. The Renter hereby agrees that Owner will be solely responsible for any loss caused due to any such act or omission of the Owner. In no event the Company shall be held liable for any act or omission of the Owner or the Renter.

SRK’s Disclaimer
The Company exercises no control over the quality, safety or legality of products listed, or over the truthfulness or accuracy of the Listing, or over the ability of Owners to rent the Allowable Goods for Rental or over the ability of the Renter to pay for the rental of such goods. Any security deposits or guarantees required by the Owner shall be decided by the Owner and will be covered in the Listing. The Company shall solely act as an escrow agent in case of collecting, holding, retaining and refunding such security deposit for rental of any Listed goods for a duration of such rental cycle.

Remedies and Disputes
Users are encouraged to resolve disputes between members. Dispute resolution is the sole responsibility between the Owner and Renter. User acknowledges that the Company is not responsible for any dispute resolution.

Delayed Payment Charges
Charges are levied in case of delayed payment for products rented on EMR (Easy Monthly Rent). Post the due date, delayed payment charges are levied at @2% per month on the delayed payment.

Terms and Conditions for Bikes
1) It is hereby agreed that all costs concerning the maintenance, safe keeping and custody of the Bike shall be with the Vendor and the Customer shall not be liable for it whatsoever.
2) Any loss or damage beyond repair of Bike should be reimbursed by Customer to Vendor.
3) Any delay in handing over the bike by the customer shall attract extra costs as per the Vendor’s policies.
4) Bikes shall be provided as per the customer requirements of the Customer. It is hereby agreed that the cost of renting the bikes shall not include the cost of the fuel, servicing, etc. which is required for smooth functioning of the bike. It is hereby further agreed that the package of the renting the bike shall be as per Customer’s requirements. The Customer shall have proper applicable licenses and no learner’s license shall be accepted by the Vendor ,Amount paid wouldn’t be refundable
5) It is hereby agreed that the Customer shall provide all original documents to the Customer during renting the bike, and such original documents shall be handed over to the customer once the bike is returned in proper and good condition. It is hereby agreed that the bike shall be rented as per Customer’s requirement and as per the Vendor’s policy.
6) Any challans / fines imposed by the competent authority shall be borne by the customer and the Vendor shall not be liable for the same. It is hereby further agreed that the return of original documents shall be subject to the customer paying the requisite challans / fines. It is further agreed that the customer shall obey all the relevant laws for using the bikes as per the prevailing applicable laws of India.
7) It is hereby agreed that any major repairs to the bike shall not be done unless there is prior written consent of the Vendor.
8) It is also agreed that the customer shall not use the bikes for any illegal / unlawful activities whatsoever, and in such case, the customer shall indemnify and keep harmless to the Vendor. It is further agreed that the Vendor reserves the right to cancel the package offered to the Customer if it was found that the Customer deviates from any of the norms / policies of the Vendor.
9) Any damage to the bike before renting it out to the customer shall be to the account of the Vendor and the customer shall not be liable for any such damage.
10) The bike rented out shall be only be used legal purposes, and any outstation use of the bike is not allowed without the prior written consent of the Vendor. For the sake of clarity, the city limits shall be considered as per the GHMC’s jurisdictional area. The Customer shall be liable to pay additional and extra costs and damages in case there is any deviation from this rule.
11) The bikes rented out by the Vendor to the Customer shall be equipped with GPS technology and other such technologies as may be required for smooth functioning of the bike. It is further agreed that the bikes shall be rented out between 9 am to 9 pm, any day of the week and the same has to be done online. It is further agreed that in case the Customer opts for pick up or drop services they will be liable to pay extra charges as may be levied by the Vendor.
12. The Vendor hereby reserves the right to cancel the booking if it is found that there are any deviations / lapses in the KYC verification of the Customer at any stage during the term of this Agreement.
The website, www.sabrentkaro.com (the “Website”) and mobile app, Sabrentkaro (the“App”, collectively as “SRK”) and any related services through SRK (the “Services”) are owned, handled and operated by Marketplace IT Solutions Private Limited (the “Company”). The Services rendered enable a registered user of SRK ("User"/ “You”) to rent goods/ services that are allowed and in compliance with the Listing Policy. Thus you are solely responsible for all the information given under the listing of goods intended to rent.
